1.(A) The terms and conditions below may be varied at any time, with or without notice to you, at our sole discretion. you accept that these must be read in conjunction with the current terms and conditions available at www.danielsuarezphotography.com.​ 1.(B) by accepting these terms and conditions, you acknowledge that you are at least eighteen years of age, or the legal age to form a binding contract within your legal jurisdiction. 1. (C)we will not be responsible for any failure or delay in providing services to you due to any events beyond our reasonable control including but not limited to acts of god or elements of nature (including fire, flood, earthquake, storm, hurricane or other casualty), war, civil commotion, labour disputes, strikes, pandemics, government regulation or restriction.

2. (A) a signed contract and retainer fee are required to reserve the dates and times of the event(s). if the event(s) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the client, the retainer fee is non-refundable and shall be liquidated damages to the company. 2.(B) the client shall also be responsible for payment for any of the company's materials charges incurred up to time of cancellation.

3. (A) it is the clients responsibility to arrange bookings and payments (if necessary) for locations, this is important especially in case of rain (e.g. hotel foyers, private premises etc.). limitations from venues, please note that daniel suarez photography governed by the restrictions imposed by churches and venues. In some cases, venues restrict the movement of photographers, the use of flash or in extreme cases prevent the taking of photographs at all. 3. (B) it is the responsibility of the client to inform themselves of these restrictions and inform daniel suarez photography prior to the wedding date. daniel suarez photography will not be held responsible for any lack of photographs delivered due to these restrictions. 3.(C) The CLIENT and the COMPANY agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT. 3.(D)

4.(A) you acknowledge that you are familiar with our style, and that our work is continually evolving and are of a unique and artistic nature, that the photos taken may be different from those taken in the past and that the studio will use their expertise and artistic judgement to create images consistent with their vision of the wedding. 4.(B) our editing encompasses colour grading of all selected images for the client in photoshop/lightroom, however, our prices do not include cropping or advanced editing/retouching such as individual removal of pimples, scars, double chins or distracting elements. additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out.  4.(C) image storage, daniel suarez photography will keep copies of both your finished jpegs for two years and your raw files for one year from the date of your wedding. 4.(D) The COMPANY is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of the COMPANY.

 

5.(A) You acknowledge that you have retained us as the sole and exclusive professional photographer for your event and that we retain the right to discontinue services, without refund or compensation, should other vendor’s or guests actions or activities interfere or impede our ability to perform such services.

6.(A) We will not tolerate our photographers being in an unsafe or illegal environment and if we feel as though our personal safety is at risk for any reason we will leave the event without refund or compensation.​ 6.(B) any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said person’s own risk. the photographer cannot be held responsible for any personal accidents or incidents incurred.

 

7(A). we are often booked up to two years in advance; therefore we require a non-refundable booking retainer paid for all packages to complete the booking. final payment is split with ½ balance being due 2 months prior to your event and final ½ required no later than one month prior to wedding.

8.(A) it is noted that your starter album will be designed to show your complete wedding day story depending upon how many final images you receive. average album sizes are 20 page. you are entitled to 2 rounds of changes to the initial design each round thereafter will be charged at $50. album designs can take up to 8 weeks for the initial design year-round.

9.(A). we cannot be held responsible for any damages, extended delivery time or loss to products sent via postal services. we will pursue the courier service and lodge a formal investigation if your package has not arrived within the online tracking time frame. we will ensure all avenues and effort is made to the best of our ability to find and deliver your products, however no refund or compensation will be made. it is our sole discretion whether to provide a replacement product.

10.(A).  all images are provided to you with a ‘personal use, royalty free, perpetual licence’. you are free to print your photos and make copies of your images. you may also submit them to the ‘real weddings’ sections of online or print publications. we only require that you acknowledge daniel suarez photography as the photographer and request a credit and website link when using images in notices and media (ie. magazines, newspapers, blogs, websites, etc).​ 10 (B) t is a breach of copyright to give any and all images to others; including but not limited to vendors, employees and contract photographers who photographed your wedding, suppliers, designers, stylists, venues, artists etc. you must refer everyone, bar yourselves back to us for express permission to use watermarked images.  penalties of up to $500 per image will be charged to you for this breach. penalties of up to $1,000 per image will also be incurred by the party using the images. daniel suarez photography owns and retains full copyright of any and all images taken. permission is granted by you to use the images as we see fit for all media, marketing and promotion. including but not limited to film, television, online and print.
